On November 5, 2016 Marlan will be presenting at the Walt Disney World Swan and Dolphin Resort in Lake Buena Vista, Florida. Healthcare Enforcement Compliance Institute

On October 23, 2016 Marlan will be on a panel at the HCCA Healthcare Enforcement Compliance Institute in Washington, D.C. He will be participating with representatives from the FCA defense bar, HHS-OIG and the Civil Division of the Department of Justice regarding the topic: “Negotiating False Claims Act Settlements”.

On October 24, 2016 Marlan will participate as a panelist at the HCCA conference in Washington, D.C. The panel discussion is titled “Advanced Discussion: Kickback Stark and False Claims Act”. The panel will feature top Stark attorneys from the relators bar and the defense bar who will be discussing many of the nuances involved in litigating Stark, kickback and FCA cases.

The United States Supreme Court Expands Coverage of the False Claims Act

The United States Supreme Court has upheld the “implied certification” theory of liability in a False Claims Act case, meaning that a defendant can be liable under the False Claims Act for billing the government for goods or services when the defendant is not in compliance with material statutory, regulatory, or contractual requirements related to those good or services.
